SMS Terms and Conditions

These SMS Terms and Conditions govern text messages sent by or on behalf of A Guy That Designs, referred to as “AGTD,” “we,” “us,” or “our.”

By voluntarily opting in to receive text messages from AGTD, you agree to these SMS Terms and Conditions. Your use of our products and services may also be governed by our Terms, Conditions, and Company Policies and our Privacy Policy.

1. Program Name

The name of this messaging program is the A Guy That Designs Customer Care SMS Program.

Messages will identify A Guy That Designs or AGTD as the sender when reasonably appropriate. Our primary text-messaging number is:

2. Program Description

The A Guy That Designs Customer Care SMS Program provides two-way, conversational communications related to a customer’s inquiry, quote, order, project, or business relationship with AGTD.

Messages may include:

• Responses to contact and quote requests
• Questions needed to prepare an estimate
• Requests for measurements, quantities, photographs, or artwork
• Quote and estimate information
• Artwork-proof notifications
• Revision and approval requests
• Appointment scheduling and coordination
• Project, production, and order-status updates
• Pickup, shipping, delivery, and installation information
• Invoice, deposit, balance, and payment reminders
• Responses to customer-service questions
• Follow-up concerning an active inquiry or project

This customer-care program is not intended for unsolicited bulk advertising. Consent provided for customer-care messages will not be used to send unrelated promotional campaigns unless you separately consent to receive those messages.

3. How You Opt In

You may consent to receive text messages from A Guy That Designs by:

• Entering your mobile number on an AGTD contact or quote-request form and actively selecting the separate, optional SMS consent checkbox
• Initiating a text-message conversation with our business texting number
• Otherwise clearly requesting that AGTD communicate with you by text

The SMS consent checkbox on our website is optional and is not selected by default. You may submit a contact or quote-request form without consenting to receive text messages.

Consent to receive text messages is not a condition of purchasing a product or service from A Guy That Designs.

By opting in, you confirm that:

• The telephone number you provided is accurate
• You are the subscriber, account holder, customary user, or otherwise authorized user of that telephone number
• You authorize A Guy That Designs to send customer-care text messages to that number
• You understand that message and data rates may apply

4. Consent Records

AGTD may maintain records showing when and how you consented to receive text messages.

Consent records may include:

• Your mobile telephone number
• The date and time consent was provided
• The form or webpage where consent was provided

5. Message Frequency

Message frequency varies.

The number of messages you receive will depend on the nature of your inquiry, the activity associated with your project, the number of questions or approvals required, and whether customer-service follow-up is needed.

You may receive multiple messages during an active quote, design, production, installation, delivery, billing, or support conversation. You may receive few or no messages when no active communication is required.

We do not guarantee that messages will be sent at any particular frequency or on any specific schedule.

6. Message and Data Rates

Message and data rates may apply.

Charges depend on your wireless carrier, device, mobile-service plan, and any roaming or data arrangements that apply to your account.

A Guy That Designs does not charge a separate subscription fee for participating in this customer-care SMS program. However, AGTD is not responsible for charges imposed by your carrier or mobile-service provider.

7. How to Opt Out

You may also use another supported opt-out request, such as CANCEL, END, QUIT, or UNSUBSCRIBE, when recognized by our messaging provider.

After you opt out, you may receive one final text message confirming that your request has been processed. We will then stop sending messages through this program unless you later provide new consent.

Opting out of text messages does not:

• Cancel an existing quote, order, project, appointment, or invoice
• Cancel any other agreement with A Guy That Designs
• Eliminate an outstanding payment obligation
• Prevent AGTD from contacting you through email, telephone, mail, or another appropriate method

If communication remains necessary to complete an active transaction, project, payment, legal obligation, or customer-service matter, we may contact you through a non-SMS method.

8. Resubscribing After an Opt-Out

After opting out, you may resubscribe by:

• Submitting new consent through an AGTD website form
• Initiating a new text conversation and clearly asking to receive text messages again
• Replying START when that option is supported or offered in the opt-out confirmation

We may require a new affirmative consent record before resuming text-message communications.

10. Automated and AI-Assisted Communications

Some text-message communications may be organized, drafted, categorized, or sent with assistance from automated software or an artificial-intelligence-assisted customer-service system.

Our AI-assisted secretary or communications system may be referred to as Evelyn.

Automated or AI-assisted messages may help:

• Respond to common customer questions
• Collect project and quote information
• Prepare suggested responses
• Organize communications
• Identify messages that may require follow-up
• Provide routine project or customer-service information

An automated or AI-assisted message does not create a binding price, guarantee, refund decision, project deadline, production commitment, legal agreement, or change in project scope unless confirmed by an authorized representative of A Guy That Designs.

11. Customer Responsibilities

You are responsible for ensuring that the mobile number you provide is current, accurate, and authorized for your use.

You agree not to use our text-messaging service to:

• Impersonate another person or business
• Send fraudulent, unlawful, abusive, or threatening content
• Transmit malware or harmful files
• Attempt to access information without authorization
• Interfere with our communications systems
• Send content that violates another party’s rights

We may limit or end text-message communications if messages become abusive, unlawful, fraudulent, threatening, excessively disruptive, or unrelated to a legitimate business inquiry.

12. Telephone Number Changes

Please notify us if you change, transfer, deactivate, or surrender the telephone number enrolled in our messaging program.

Before giving up a telephone number, reply STOP to opt out or contact us so that we can remove the number from our records.

AGTD is not responsible for messages received by a new subscriber after a number has been reassigned when we were not notified of the change.

13. Message Delivery and Carrier Availability

Text-message delivery depends on participating wireless carriers, telecommunications networks, your mobile device, your service plan, cellular or internet availability, and systems outside AGTD’s control.

Messages may be delayed, blocked, filtered, interrupted, duplicated, or undelivered.

Carriers are not liable for any delayed or undelivered messages.

A Guy That Designs does not guarantee that every SMS or MMS message will be received, displayed correctly, or delivered within a particular time.

Not all carriers, devices, telephone numbers, or service plans support every SMS or MMS feature.

14. No Emergency or Immediate-Response Service

Text messaging is offered for convenience and does not guarantee an immediate response.

Do not use this messaging program for emergencies, urgent safety concerns, or situations requiring immediate assistance.

For an emergency, call 911 or the appropriate emergency-service provider.

15. Sensitive Information

Do not send highly sensitive information through ordinary SMS or MMS messages.

This includes:

• Social Security numbers
• Complete payment-card numbers
• Bank-account credentials
• Account passwords
• Government identification numbers
• Medical records
• Other confidential information unrelated to your project

When sensitive information is required, AGTD may direct you to a more appropriate or secure communication method.

17. Changes to the Messaging Program

We may modify, suspend, or discontinue all or part of the SMS program at any time.

We may also change the telephone number, messaging provider, available features, message types, or operating procedures associated with the program.

We are not required to maintain the SMS program indefinitely or provide advance notice of changes when immediate action is necessary for legal, security, carrier, technical, or operational reasons.

18. Changes to These SMS Terms

We may update these SMS Terms and Conditions to reflect changes in our services, business practices, messaging providers, carrier requirements, technology, or legal obligations.

Updated terms will be posted on this page with a revised effective date.

Your continued participation in the SMS program after an update constitutes acceptance of the revised terms. You may opt out at any time by replying STOP.

19. Relationship to Other Agreements

These SMS Terms apply specifically to AGTD text-message communications.

Your quote, order, project, website, marketing service, design service, or other purchase may also be governed by a separate estimate, proposal, contract, or our Terms, Conditions, and Company Policies.

If a signed written agreement contains messaging terms that conflict with this page, the specific written agreement will control to the extent of that conflict.
